The fine print.

Template, not legal advice. These are solid starting points written for a creator management agency, but they are not finished legal documents. Have a qualified lawyer in your country review and adapt them before you publish or rely on them, especially for GDPR and the rules around adult content and age checks. Anything in a yellow box is for you to fill in.
Privacy Policy
How Sway collects, uses and protects your personal information.
Who we are
This site, swayofm.com, is operated by Sway — full legal / business name (“Sway”, “we”, “us”), registered address. For anything about your data, contact us at privacy@swayofm.com. We are the data controller for the information described here.
What we collect
- What you give us through the apply form: your name or creator name, email, social and page links, date of birth, the options you tick, and anything you write to us.
- Age-verification result from our verification provider when you onboard: confirmation that you are 18 or over, and a reference. The provider handles your ID document; confirm what, if anything, is passed back to and stored by Sway.
- Messages you send us by email or social.
- Basic technical data your browser sends (such as IP address) and, if we add analytics later, limited usage data. The site sets no / which tracking cookies today.
Why we use it, and our legal basis
- To assess your application and talk to you about working together — steps taken at your request before any contract.
- To provide our services once we agree to work together — performance of our contract.
- To verify you are 18 or over and keep the records we are required to keep — legal obligation and our legitimate interest in running a lawful, safe agency.
- To send you updates only if you have agreed — consent, which you can withdraw at any time.
Who we share it with
We only share what is needed, with providers that process data on our behalf: our email provider (Zoho Mail, EU), our website host (host name once chosen), our age-verification provider (provider name, e.g. Veriff / IDnow), and any tools we use to run the business. Where data leaves the EEA, we rely on appropriate safeguards. We never sell your data.
How long we keep it
Applications we don’t take forward: kept up to 6–12 months, then deleted. Records for creators we work with, including age-verification records: kept for as long as we work together and for X years afterwards where the law requires it.
Your rights
Under the GDPR you can ask to access, correct, delete, restrict or object to our use of your data, ask for a copy to take elsewhere, and withdraw consent. Email privacy@swayofm.com and we will respond within one month. You can also complain to your data protection authority (name your country’s authority).
Security & children
We use reasonable measures to protect your data. Sway is strictly for adults: we do not knowingly collect data from anyone under 18, and we delete it if we find we have. See the 18+ & Consent section below.
Changes
If we change this policy we will update the date at the top and, for big changes, tell you directly.
↑ Back to topTerms
The terms for using this site and applying to Sway.
Agreeing to these terms
By using swayofm.com or sending an application, you agree to these terms. If you don’t agree, please don’t use the site.
Who can use Sway
You must be 18 or over to use this site, apply, or work with us. See the 18+ & Consent section.
What Sway does
Sway is a creator management agency. We help creators with content planning, growth, fan engagement and pricing. The exact services, fees and arrangement for anyone we work with are set out in a separate written agreement — these terms don’t create that relationship on their own.
Applications
Sending an application is not a guarantee that we will work with you, and it does not create a contract. We choose who we take on and may decline without giving a reason. You confirm the information you give us is true and yours to share.
Your responsibilities
- Give us accurate information.
- Your accounts and your content stay yours; you are responsible for them.
- Only share content that is lawful, that you have the rights to, and that features only consenting adults aged 18+.
Our content
The Sway name, logo, wording and design on this site belong to Sway and may not be copied without permission. Your content remains yours.
No guarantees & liability
We work hard but we can’t promise specific results, income or growth, and we make no income claims. To the extent the law allows, Sway isn’t liable for indirect or unexpected losses from using this site. Nothing here limits liability that can’t be limited by law.
Ending
You can stop using the site any time. Any working relationship is ended as set out in its own agreement.
Law
These terms are governed by the laws of your country / jurisdiction, and disputes are handled by its courts.
↑ Back to top18+ & Consent
Our age policy, how we verify, and what you confirm when you work with us.
Adults only
Sway works only with creators who are 18 years or older. There are no exceptions. This protects you, protects us, and keeps every account safe on the platforms we use.
How we verify your age
When you apply, you confirm you are 18+. Before we onboard anyone, you complete a verified government-ID age check through an EU-registered age-verification provider (e.g. Veriff, IDnow, Ondato). It takes a couple of minutes: a photo of your ID and a quick selfie check. The provider handles your document securely; we receive confirmation that you passed. We do not work with anyone who will not or cannot verify.
Zero tolerance for minors
We never work with, represent, or handle content involving anyone under 18. If we ever suspect a minor is involved, we stop immediately and report it to the relevant authorities as required by law.
What you confirm (consent)
- You are 18 years or older and will complete age verification before onboarding.
- You own your accounts and content, or have the rights to them.
- Everyone featured in your content is a consenting adult aged 18+, and you can show their consent and age if asked.
- Your content is lawful and was made consensually.
- You agree to how we handle your data, as set out in the Privacy Policy.
Withdrawing & contact
You can withdraw consent to data processing at any time by emailing privacy@swayofm.com; some records may be kept where the law requires. Questions about this policy go to the same address.
